Terms for experiences at the Meadow
Booking, payment, cancellation and liability. The visitor rules form part of every experience too.
1. Who we are and what these terms cover
These terms govern the booking and provision of experiences at the Meadow — an overnight stay, private walks with the animals, hire of the meadow and other experiences offered on the Experiences at the Meadow page. The provider is the association Nech mě růst, z.s., with its registered office at Dandova 2619/13, Horní Počernice, 193 00 Praha, IČ: 19602529, registered in the register of associations kept by the Municipal Court in Prague under file no. L 77924, e-mail info@nechmerust.org (hereinafter the “provider” or “we”). The experience is booked by the guest (hereinafter “you”).
These terms do not apply to the sale of goods in our shop — the general terms & conditions apply to that. They also do not apply to donations and virtual adoptions, which are governed by a gift contract. The [visitor rules of the Meadow](/navstevni-rad) form part of every experience; they describe how to behave among our animals. Please read them before you confirm a booking, because those rules are not a formality.
We offer experiences for the sake of the animals, not for turnover. The proceeds go towards their feed, hay and veterinary care. We mention this because it also explains how we behave in situations these terms do not cover — when in doubt, we will decide in your favour.
2. How a booking comes about
A booking has two steps, and the contract only comes about with the second one:
- A non-binding request. In the calendar next to the experience you pick your dates (for experiences with time slots, one day and the slots within it) and submit the form. With this step you pay nothing and commit to nothing — you are simply telling us which dates you are interested in. You will receive an e-mail confirming that the request has arrived, with a booking code.
- Our confirmation. We check the dates — the animals, the weather, other events and our own time all come into it — and reply to you. Only upon delivery of our confirmation is the contract concluded and the dates are yours.
An unconfirmed request holds the dates only for a limited time (72 hours by default), after which the dates are released to others. This is not pressure on you — it protects against a single unfinished form blocking an entire week. We always get back to you, even when the dates cannot work.
We may decline a request and are not obliged to give reasons — typically because the dates have been taken in the meantime, another event is taking place then, or the animals cannot cope with it in that period. If a request is declined, no obligation arises for you and any amount already paid is refunded in full.
A booking may be made only by a person over 18. If you are booking for several people, it is your responsibility to have passed these terms and the visitor rules on to them — we will go through them again on site, but we do not want it to come as a surprise to anyone.
3. Price and payment
The price is stated with each experience and is final, including all taxes. For experiences charged per night or per time slot, it is calculated by the number of nights or slots; for experiences priced per group, the price does not change with the number of people until the stated number is exceeded. What is and is not included is listed with the experience.
Payment is by bank transfer to account 2002645872 / 2010 (Fio banka, a.s.); we have no payment gateway. The payment details including the variable symbol are sent to you together with the booking confirmation. Unless stated otherwise with the experience, the amount is payable within 14 days of confirmation, and if the experience starts sooner, then no later than the day before it begins.
If payment does not arrive by the due date, we will contact you once more. If you then do not respond, the booking lapses and we release the dates — we charge you no penalty.
4. Withdrawal within 14 days — does not arise for a dated experience
This needs saying up front, because with online purchases a fourteen-day return is taken for granted: for an experience provided on a specific date, there is no right to withdraw from the contract within 14 days without giving a reason. This follows from § 1837(j) of the Civil Code, which grants this exception to accommodation, transport, catering and leisure services provided on a specified date.
The reason for the exception is simple, and doubly true here: we cannot sell reserved dates to anyone else, because both the animals and we have that day set aside and we do not let more people onto the Meadow at once. This does not mean you cannot get out of a booking — it is simply handled by the cancellation terms below, not by a 14-day withdrawal.
The reverse also holds: an experience without fixed dates (a gift voucher whose dates are chosen later) is an ordinary service and you do have the right to withdraw within 14 days — as long as you have not selected the dates and the experience has not begun. It is enough to send the withdrawal by e-mail to info@nechmerust.org.
5. Cancellation terms
You can cancel a booking at any time — just e-mail info@nechmerust.org with your booking code. Unless stated otherwise for a particular experience, we refund the amount paid as follows:
- Cancelled more than 14 days before arrival: we refund the entire amount paid.
- 14 to 3 days before arrival: we refund half.
- Less than 3 days before arrival, or a no-show: the amount is not refunded.
We refund within 14 days of the cancellation, to the account from which the payment came. We charge no cancellation fee beyond this table.
Serious reasons are not handled by the table. Illness, a death in the family, quarantine, a breakdown on the way — write and tell us what happened, and we will agree on moving the dates or on a refund. This sentence is not marketing; it is how we actually do it, which is why it is written here.
If a particular experience states its own cancellation terms (they are shown next to the calendar before you submit a request), those apply — they are more specific. We write this here so there is no doubt which of the two texts prevails. 6. When we cancel the dates
It happens, and it is better to know in advance what follows. We may cancel dates because of the animals (illness in the herd, veterinary measures, a birth), because of the weather (a gale, waterlogged ground, extreme temperatures) or because of an emergency on our side. In such a case we will offer you alternative dates, and if they do not suit you, we will refund the entire amount paid within 14 days. We deduct nothing.
We cannot cover travel costs or other expenses you incurred around the dates — we are a small association and such a guarantee would break us. That is why we cancel only when there is no alternative, and let you know as early as we possibly can.
7. How the experience runs
Arrival and departure times are stated with the experience and we send them with the confirmation as well. The last stretch of the way to the Meadow is on foot — how to get to us is on the Getting to the Meadow page. If you arrive earlier or later than agreed, let us know; we are not a hotel with a reception desk, we are people who will come out to meet you.
The programme may change on the spot. The animal you were looking forward to may be unavailable that day — it is being treated, giving birth, or simply not in the mood for strangers. This is not a defect in the service, it is life in a sanctuary, and we always try to make up for it with something else. A defect would be our failing to provide, as a whole, what we promised.
Following the [visitor rules](/navstevni-rad) is a condition of participation. If someone repeatedly endangers themselves, others or the animals, we may end the experience; in that case no refund arises. It is the one situation in which we do not refund without agreeing something with you first.
8. Children
Children are welcome here, and for many of them the Meadow is the first animal they ever touch. At the same time it is a place with large animals, so: a child under 15 may take part only with an adult who is responsible for them throughout — a legal guardian, or an adult whom the legal guardian has authorised in writing to accompany them. Tell us about allergies and health limitations already in the note on your request. We have hay, dust, fur, feathers and stinging insects — and it is far better to know in advance than in the middle of an enclosure.
An experience for a group of children without their parents (a school, a troop, a club) is arranged separately, not through the form — it requires written registration from the legal guardians. Write to us at info@nechmerust.org and we will arrange it.
9. Liability
We are liable for damage caused by our animals — under § 2933 of the Civil Code, and even where we neglected nothing in supervising the animal. Nothing in these terms or in the visitor rules means that you waive your right to compensation; such a provision would be invalid under § 2898 of the Civil Code, which is why you will not find one here.
The rules in the visitor rules are not there to release us from anything, but because they work — a horse you do not approach from behind does not kick. Someone who was given the rules and went against them bears part of the consequence themselves under § 2918 of the Civil Code; but that is all that being informed does legally.
We are not liable for belongings left at the Meadow — there is no cloakroom or lockable place. And conversely: if you cause damage to us or to the animals, you are liable for it under the general rules of the Civil Code.
We recommend checking your own insurance — accident and liability cover. It is not a condition of participation and you do not have to prove anything to us; it is the advice you would get before any outdoor activity involving animals.
10. If the experience goes wrong for you
Tell us right there on the spot, so that something can still be done — that is the best outcome for both sides. If that was not possible or you only realised at home, write to info@nechmerust.org. Report the defect without undue delay, no later than 6 months from the provision of the experience.
We will decide on a complaint within 30 days of it being made (§ 19 of Act No. 634/1992 Coll., on consumer protection). It can be resolved by providing the experience again, a reasonable discount, or a refund of the price — depending on what makes sense in the situation and on what you want.
11. Out-of-court resolution of disputes
If we do not reach agreement, you can turn to the Czech Trade Inspection Authority, which is competent for the out-of-court resolution of consumer disputes — Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, www.coi.cz. A proposal may be submitted within 1 year from when you first asserted your right with us, and the procedure is free of charge for you. Supervision of consumer protection is likewise carried out by the Czech Trade Inspection Authority.
12. Personal data
For a booking we need your name, e-mail, possibly a phone number, the dates and the number of guests — nothing more. The details, including how long we keep the data and whom we pass it to, are in the privacy policy. One thing we mention here as well, because people usually do not expect it: we record confirmed dates in our Google Calendar so they are not double-booked, and your name, the dates and the number of people go into it.
13. Final provisions
The contract is governed by the law of the Czech Republic. The decisive version of the terms is the one in force on the day we confirmed your booking — a later change does not apply to dates already confirmed. If any provision is invalid, the remainder is unaffected. This does not affect your consumer rights arising from generally binding legal regulations.
